These Terms of Service ("Terms") govern your use of O'Malley's Gym's website, forms, and services. By contacting us, submitting a form, purchasing a membership or pass, or using our facilities, you agree to these Terms.

"O'Malley's Gym" ("O'Malley's," "we," "us," or "our") refers to the independent, family-owned gym operating locations in Troutdale, Milwaukie, and Beaverton, Oregon.

Memberships & Passes

We offer monthly memberships, yearly memberships paid in full, and day, week, and one-month passes. Current pricing is listed on our Memberships page and may change from time to time.

• Memberships are month to month with no long-term contract and no sign-up or initiation fee
• 24-hour access requires a key fob, which carries a one-time fee
• Passes are valid during staffed hours only
• Submitting a form on our website does not create a membership; your membership begins once signup is completed with our staff

All memberships are subject to acceptance by O'Malley's Gym.

Facility Access & Rules

By using our facilities, you agree that:

• Key fobs are issued to individual members and may not be shared or used to admit others
• No guests or drop-ins are permitted after staffed hours
• You will follow posted gym rules and the instructions of our staff
• You will use equipment properly and treat other members, staff, and the facility with respect

O'Malley's reserves the right to suspend or end access for anyone who violates these Terms or our gym rules.

Cancellation

Memberships may be cancelled at any time using our Membership Cancellation form. Cancellation requests sent through the general contact form or by email may not be processed. Any notice period or final billing details are confirmed when your cancellation is processed.

Assumption of Risk

Exercise and use of gym equipment involve an inherent risk of injury. By using our facilities, you acknowledge these risks and agree that you are responsible for using the facility safely and within your own physical limits. Members may be required to sign a separate liability waiver before using the facility. You should consult a physician before beginning any exercise program.

User Responsibilities

By using our website or submitting a form, you agree that:

• The information you provide is accurate and truthful
• You will not submit false, misleading, or fraudulent information
• You will use our website and services for lawful purposes only

O'Malley's reserves the right to refuse service at its discretion.

Age Requirement

You must be at least 18 years old to use this website or submit a form. By using our website, you represent and warrant that you are 18 years of age or older. Minors may use our facilities only as allowed by our gym policies.

SMS Communications

If you choose to opt in, you may receive non-marketing text messages related to:

• Membership signup follow-ups and key fob pickup
• Account, billing, and membership updates
• Replies to questions you send us
• Gym hours, closures, and facility notices

If you separately opt in to marketing text messages, you may also receive specials, promotions, and event announcements.

Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP, or request assistance by replying HELP.

SMS consent is not a condition of purchase.

Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered text messages. Message delivery is subject to carrier network availability and other factors outside of O'Malley's control.

Email Communications

If you provide an email address, we may use it for membership-related communication or to respond to your inquiry. Marketing emails are only sent to people who have opted in, and you can unsubscribe at any time.

Limitation of Liability

To the maximum extent permitted by law, O'Malley's Gym and its owners, employees, and agents shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website, services, or facilities.

Intellectual Property

All content on this website, including text, photos, logos, murals, and branding, is the property of O'Malley's Gym or its licensors and may not be used without permission.
